Motorcycle accidents caused by DUI may warrant civil suits

Autumn is beginning to creep across New Jersey. For motorcycle enthusiasts, cool, crisp days can be the perfect time for a ride. Even if a motorcyclist takes all recommended safety precautions and follows all traffic laws, there is no guarantee that other drivers will do the same. When motorcycle accidents are caused by another party, a victim may suffer or die through no fault of his or her own.

Recently, a man on a motorcycle was traveling west through an intersection. Another driver in a sedan, headed southbound, blew through the stoplight and struck the motorcycle, attempting to make a left turn. The man in the motorcycle suffered serious spinal and head injuries and was rushed to a hospital where he remains, condition unknown.

Investigators determined that the sedan driver was at fault for the crash. It was later discovered that the driver was under the influence at the time of the crash. He faces criminal charges, including several counts of assault and DWI, as well as several traffic citations. An investigation into the crash continues, and prosecutors will use evidence to try to meet the burden of proof in criminal court.

A New Jersey victim that faces similar circumstances may be overwhelmed by physical pain, loss of wages due to inability to work, expensive damage to a motorcycle or other personal property, and lasting physical and mental injury. A victim who wants to file a civil suit against a party at fault may want to contact an experienced attorney. An attorney can help a client seek justice and compensation in a court of law. Victims of motorcycle accidents face a long road to recovery, but the legal system can provide a little help to get started.
